What is a change in operations?
A change in operations is a fundamental realignment or restriction of operational processes brought about by the employer, up to and including the closure of the business or significant parts of the business. p>

What measures are considered operational changes?
According to Section 111, sentence 3 of the Works Constitution Act, a change in operations always occurs in the following cases:

- Relocation of the entire business or significant parts thereof
- Merger with other businesses and/or division of businesses li>
- Fundamental changes to the business organization, the business purpose, or the business facilities li>
- Introduction of fundamentally new working methods and production processes ul>
According to the case law of the Federal Labor Court, these cases constitute a change in operations without further ado. This means that if such a legally defined case of a change in operations exists, it is not necessary to determine whether it may also have significant disadvantages for the workforce. However, other cases are still conceivable in which a change in operations nevertheless exists.
Operational changes and the works council
If the employer plans to make operational changes, the works council has a legal right to consult advisors or experts.
If the company employs more than 300 people, the appointment must be made in accordance with Section 111 (2) of the Works Constitution Act. Below this threshold, the involvement of experts is governed by Section 80 (3) of the Works Constitution Act, whereby a more detailed agreement with the employer is always required.
