Regular works council elections are held every four years between March 1 and May 31. The 2026 works council election is just around the corner, offering all employees the opportunity to actively shape their working environment.

The first steps toward initiating works council elections

There are a few hurdles to overcome on the way to forming a new works council. But with our help, you can conduct the works council election in a legally compliant and relaxed manner. However, before the election can really get underway, the election committee must first be appointed.

  • Step 1: Appointment of the election committee by the works council

    The term of office of the works council ends at the end of the last day of the term of office, at the latest on May 31, 2026. This applies even if a new works council has not yet been elected by then. To ensure that there is no interim period without a works council, the election committee should be appointed at a works council meeting at least 10 weeks in advance (4 weeks in the case of a simplified election procedure)..

  • Step 2: Decision by the election committee on whether to use a simple or normal election procedure

    Before organizing the works council election, the correct election procedure must be determined. There is the simplified election procedure and the normal election procedure. This depends on the size of the company. For companies with 101 to 200 employees who are eligible to vote, the normal election procedure is generally used. However, the election committee has the option of agreeing on the simplified election procedure with the employer in accordance with §14a BetrVG.
