What training entitlement does the Works Constitution Act offer?

According to Section 37 (7) of the Works Constitution Act, every works council member is entitled to paid leave for a maximum of three weeks during their regular term of office in order to attend special training courses for works councils. Newly elected works council members may even attend training courses for a maximum of four weeks, provided they do not already have experience as a trainee representative.

The training entitlement includes:
– Participation in training
– Coverage of training fees
– Coverage of accommodation and meal costs
– Reimbursement of travel expenses to and from the event location
– Leave from work and continued payment of wages during the event

When is further training “necessary”?

Whether further training is necessary for the works council within the meaning of the Works Constitution Act depends on the individual's level of knowledge. The situation of the company is also a decisive factor. If, for example, a change in operations involving mass redundancies is planned, training on the subject of redundancies for operational reasons would be appropriate. The aim of further training is always to build up the specialist knowledge that is necessary for the specific work of the works council.

Who decides on participation in training?

The committee decides what training needs currently exist and determines which works council members should participate in the training program. The works council's discretion is decisive. The employer must accept the committee's decision, provided that the works council does not exceed the limits of its discretion.
